The purpose of this Policy is to establish the University of Arizona’s (University) commitment to protect the health of University faculty, staff, students, and visitors on its campuses and in its vehicles.
This policy does not apply to personal vehicles.
This Policy applies to students, employees, affiliates, associates, contractors, volunteers, and visitors.
This policy applies to the University of Arizona’s Main Campus in Tucson, University of Arizona Health Sciences Campus in Tucson, the Phoenix Biomedical Campus, and the College of Applied Science and Technology satellite campuses.
This Policy supersedes any other policy of the University on the same subject.
“Electronic Smoking Devices,” for the purposes of this Policy, are devices that simulate smoking through inhalation of vapor or aerosol from the device, including e-cigarettes, e-cigars, e-pipes, or vape pens.
The University is dedicated to providing a healthy environment for those who participate in University activities. In support of this goal, the University prohibits the use of products that contain tobacco or nicotine, which the Food and Drug Administration has identified as an addictive chemical. These products include cigarettes, cigars, pipes, electronic smoking devices (such as e-cigarettes), bidis, kreteks, hookahs, water pipes, and all forms of smokeless tobacco. Littering campus with remains of tobacco or smoking-related products also is prohibited.
Exceptions
Smoking Cessation Products. Smoking cessation products, such as nicotine patches, nasal sprays that contain nicotine, and nicotine gums are permitted.
Controlled Research. Tobacco use may be permitted for controlled research with prior approval of the administrator responsible for the facility and, in the case of smoking, the University Fire Marshal. Smoke generated from research use or burning of tobacco will be controlled locally in a chemical hood or other exhaust system that provides 100% exhaust to the outside.
Educational Purposes. Tobacco may be used in classroom instruction/experiments. All educational purpose exceptions must be approved in advance by the Provost or the Provost’s designee.
Other Permitted Uses
Smoking and/or tobacco may be permitted for traditional, cultural, or religious uses, provided that such uses have been approved in advance by the Provost or the Provost’s designee.
All University employees, students, visitors, guests, and contractors are required to comply with this policy. Organizers of public events, such as conferences, meetings, public lectures, social events, and cultural events using campus facilities will be mindful of this Policy and encourage compliance.
University students, faculty, and staff who encounter someone who is violating this policy are encouraged to respectfully inform that individual about the policy and encourage compliance.
Concerns regarding violations of the policy should be referred to the appropriate unit for review and action:
The success of this policy depends on the entire campus community and its members being willing to hold one another accountable. Whenever possible, concerns about tobacco and nicotine use should be respectfully addressed at the time such concerns arise. Individuals who are considering disciplinary action against an employee or student for violating this policy should consult with Human Resources or Student Affairs.
Can I use e-cigarettes?

How will I know if I’m on University of Arizona property?

Am I required to quit smoking in order to keep my job or my student enrollment at UA?
The policy only regulates what people do while they are on a University campus or in a University vehicle. You are free to make your own personal choices at other times and in other locations.
What will happen if I don’t follow the policy?
Supervisors will discuss the policy with their employees, affiliates, associates, volunteers, or contractors. Some employees who wish to continue to smoke may be able to arrange to leave campus on breaks or lunch. An employee who persists in violating the Smoking and Tobacco Policy may be subject to disciplinary action. Refusal to follow the policy by a DCC could result in a termination of that individual’s relationship with the University. Visitors may be required to leave campus if they fail to comply. Students may be subject to action under the Student Code of Conduct.

This policy governing building alterations and renovations is necessary to ensure health and safety and the appropriate coordination of building systems. Projects started without proper review have had the following problems in the past:
All alterations and/or renovations of University buildings must comply with this policy to ensure project coordination and review, code compliance, and safety.
"Alteration" and "Renovation," for purposes of this policy, are defined as any work that modifies the permanently constructed facility. This includes adding, replacing, or relocating doors, walls, or windows; altering or penetrating corridors or ceilings; adding on to or dividing existing space; or working on any building utility system, including electrical, plumbing, ventilation, fire alarms, fire sprinklers, security systems, laboratory fume hoods, and telecommunications.
This policy is effective immediately and shall remain in effect, without exception. Non-approved projects that are initiated in violation of this policy will be corrected, if necessary, by Facilities Management, with all associated costs charged to the responsible unit. Noncompliance may result in disciplinary action.

The University of Arizona has established a campus-wide Keyless Access and Security System Program to better manage its resources and facilities. This system will utilize the University's CatCard as the "key" for future integrated management and access to University of Arizona services and facilities. The focus of this system is to address the issues of loss prevention, personal safety, and convenience through the use of this standardized technology. The system will provide a computerized control center to manage, process, record, and notify appropriate response agencies as needed. On July 7, 1997, the University of Arizona Procurement and Contracting Services issued a memorandum regarding sole source purchases of Amer-X Security, Inc. (vendor).
All new construction, remodeling projects, facility expansions, modular building projects, and any other major modification to a University building, structure, or facility must include planning to accommodate the Keyless Access/Security System or have obtained an exception as provided by this policy.
Facilities Management will oversee the activities of Amer-X Security, Inc. (vendor). Facilities Management staff along with the vendor will act in an advisory capacity to facilitate user meetings, determine design criteria, determine location and type of peripheral devices, and design system layout. Vendor personnel will facilitate the proper interfacing capabilities of all related systems applications for Keyless Access and Security Systems. This is an ongoing program. In many cases the design criteria and budget demands may limit the scope of work to rough-in conduit and boxes for future use. Since the entire campus will move to this technology, it is imperative that the rough-in work be done during the construction and/or remodel stage
The vendor, with Facilities Management; Planning, Design and Construction; and/or Real Estate Administration, will work with the assigned architectural and engineering firms and/or department heads and building monitors to facilitate and support the following areas:
Exceptions can be granted only by the Senior Vice President for Business Affairs, and then only to accommodate extenuating circumstances temporarily. Facilities Management will take the necessary and appropriate action to correct any projects that are initiated in violation of this policy. Any entities that violate the policy resulting in additional cost will be required to bear the cost to make necessary corrections. This policy applies to all University and University-related events, regardless of the source of funds used to pay for the event.
The Arizona Student Unions is the designated campus department responsible for the provision of food and beverage services for the University. Arizona Catering Company supports University functions and organizations requiring such services with a focus on the safety and health of the University's students, faculty, staff, and guests. The Office of the Executive Director, Student Unions, coordinates and approves the use of food and beverage services within the scope and applicability of this policy.
When events on the main campus are planned that include food, and the total cost exceeds $750.00, departments and organizations must contact the Arizona Catering Company to make food service arrangements. Departments at AHSC have the option of using the Banner University Medical Center food service. Events costing less than $750.00 and events catered off campus are exempt from this policy. Therefore, in the exempted instances departments may either use the Arizona Catering Company or make arrangements through an off-campus vendor with whom Purchasing and Contracting has executed a current Master Agreement. A Master Agreement must be in place before a vendor is allowed to cater any University event.
Only those vendors operating as specified under existing contracts with the Arizona Catering Company are authorized to provide food for retail sale on campus.
The Director, Student Unions, is authorized to grant a waiver in special circumstances. Waiver decisions will not be based on price. A Department or University organization's request for a policy waiver is to be submitted two weeks in advance of the event. A response to the request will be provided within forty-eight (48) hours. When a waiver is granted, the sponsoring department or organization may obtain the catering services of an off-campus vendor with whom Procurement and Contracting has an executed Master Agreement and who is in possession of all permits and licenses required by federal, state, and local laws as applicable.
Decisions that arise from waiver requests may be appealed to the Assistant Vice President of Auxiliary Services.

The campus grounds and properties of the University of Arizona (the “University”) are devoted to and maintained for the sovereign function of providing higher education to the people, and are not places of unrestricted public access.
The University is committed to protecting the free speech rights of students, faculty, staff, and invited guests. The purpose of this policy is to respect the Campus Community’s rights to free speech and expressive activity within public and designated public forums, while preserving public health, safety, and welfare; the normal business uses of the campus; and the rights of others to legitimately use and enjoy the campus.
The University may regulate the time, place, and manner of free speech and expressive activities in order to prevent unreasonable interference with or disruption of its educational, research, outreach, and business functions, and normal or scheduled uses of University property by the Campus Community, as well as to protect public health, safety, and welfare. Commercial Activity, as defined below, is prohibited on campus except as authorized by the Business Practices Guidelines Policy, guidelines on "Sponsored Commercial Activity on University Property."
"Authorized," within this document, means permitted by the Arizona Board of Regents (ABOR) or the President of the University or their designee.
"Building or Structure Manager” is that person with authority to grant permission to use a building or other internal space or structure.
"Business Day” means Monday through Friday, except for official University holidays.
"Camping" means the use of any part of the campus for living accommodation purposes, such as overnight sleeping activities, making preparations for overnight sleeping (including the laying down of bedding for the purpose of sleeping), storing personal belongings, making a fire, using any tents or other structures for sleeping, digging or earth breaking, and/or carrying on cooking activities. Such activities constitute camping when it reasonably appears, in light of all the circumstances, that the participants, in conducting these activities, are in fact using the area as a living accommodation regardless of the intent of the participants or the nature of any other activities in which they may also be engaging. Camping does not include Official University Activities or the ordinary use of University Structures that have been wholly or in part designated as sleeping and/or eating areas.
“Commercial Activity” means (a) all advertising, sales, purchases, or agreements for the sale or purchase of goods or services; (b) all giving, demonstration, or solicitation for the purchase or sale of goods or services provided by a person, group of persons, or other entity; and (c) all solicitations of gifts of money or other goods or services by a person, groups of persons, or other entity.
"Contact Person" means that person who is designated as the sponsoring organization’s or individual’s representative to be contacted.
"Dean of Students" ("DOS") means the University Dean of Students or their designee.
“Designated Public Forums”: The University’s campus contains buildings and property whose primary purpose is to provide education, research, and outreach. However, the University often designates areas to allow access by the University Community or to create limited forums for the discussion of certain topics or subject matter by certain speakers, each at times when the property is not being used for its devoted purposes.
“Limited Public Forum” is a subcategory of the Designated Public Forum that occurs when the University intentionally opens a Non-Public Forum to speech or to activities related specifically to defined subject matters for certain groups on certain topics.
“Major Event” means a planned gathering, including, but not limited to, a speaker, presentation, lecture, forum, conference, or rally, that meets one or more of the following criteria:
The following are excluded from the definition of a major event: spontaneous demonstrations for which there is no prior promotion or organization, weddings and private celebrations at the Student Unions, performing arts events at College of Fine Arts venues, or official University or University Unit events (not including events where a unit is merely renting its space or lending its name in sponsorship).
"Mall" refers to the grassy areas between Park Avenue and Campbell Avenue and along University Boulevard East and University Boulevard West that are designated for expressive activities or Limited Public Forums, subject to the qualifications, definitions, and procedures set forth in this policy.
“Non-Public Forums” are University buildings, structures, and property that are not designated as spaces open for public communication, activities, or expression, but instead are reserved for normal business, education, research, or other dedicated purposes.
"Official University Activity" means regularly scheduled academic classes, operations, research, business, and other activities, including special events of the University as approved by the University President, Provost, or Vice President for Enrollment Management and Student Affairs Advancement.
"Open Public Forums" consist of the streets and sidewalks generally open to the public during the times the University is open. Open Public Forums do not include, among other places defined in this policy, the interiors of University Structures or Designated Public Forums.
"Planned Demonstration" is a public manifestation of protest, condemnation, or approval; taking the form of a mass meeting, procession, picket, or similar activity, which is organized and promoted more than a day before the event.
"President" means the President of the University or the President's designee.
"Sponsoring Organization/Individual" means the individual or entity responsible for an activity on the University Campus.
"Student" means any person admitted and enrolled in one or more classes at the University, including a faculty member or employee so enrolled. Graduate students who serve as assistants, associates, or otherwise, and all other students employed part-time by the University, are classified as students for the purposes of this policy.
"Student Organization" means an organization composed primarily of students, which has received official University recognition as a Student Organization and is in good standing according to University policies and procedural regulations administered through the Associated Students of the University of Arizona (ASUA) or similar University Unit.
"Structure" means the framework of and the space enclosed by any building, booth, tent, canopy, vehicle, trailer, fence, wall, or similar object or enclosure, including but not limited to the Arizona Stadium, McKale Center, the Student Union Memorial Center, Park Student Union, and campus parking garages.
"University" means the Arizona Board of Regents on behalf of the University of Arizona, including University Units, and University employees or agents delegated with the authority to act on its behalf and on behalf of University Units.
"University Community" means all University employees, Students, invited guests, and members of the public present on the University Campus for legitimate and lawful purposes.
"University Property" and "University Campus" mean all land, buildings, and other facilities owned, operated, or controlled by the University, except that this policy does not apply to property that the University owns but over which it has legally relinquished its power of operation or control to a third party.
"University Unit" means any academic or non-academic department or division of the University or any other official entity of the University.
Signs, banners, and other material may be affixed without permission to the outdoor "kiosks" located around the University Campus. However, signs, banners, and other materials may not be affixed to the interior or exterior of any other University Structure without permission from the particular Building or Structure Manager or other person with authority to grant such permission. Permission may be provided in the form of building guidelines or regulations currently in effect for a particular structure. Signs, banners, and other material may not be affixed to any plant, statue, sign, lamppost, stairs, or other inanimate object on campus without the permission of the Dean of Students.
Major events must abide by the requirements below. Failure to comply with these requirements may result in immediate cancellation of the event or exclusion from using University facilities and spaces in the future.
These requirements supersede any requirements established by individual University Units that oversee particular facilities or spaces, unless those requirements are more stringent. If a unit receives a request to reserve one of the facilities or spaces it oversees for a major event, the unit must promptly notify the CUC, which will notify appropriate University Units.
If an imminent threat to safety or property arises during an event, the highest ranking UAPD officer, DOS employee, or University administrator may terminate the event.
In accordance with A.R.S. §15-1633, no university resources will be used to influence the outcome of an election or advocate support for or opposition to pending or proposed legislation.
In furtherance of the educational, research, service, and other legitimate functions of the University, and in order to protect public health and safety, no part of the campus, including the Mall and Park Student Union outdoor space, is generally available for organized activities after 10:30 p.m. and before 7:00 a.m., except for Official University Activities or Authorized Activities.
Camping is not allowed on University Property.
The University Campus may not be used in any manner that would identify or involve the University itself as endorsing or sponsoring a partisan, political, sectarian, or religious position or a candidate for political office.
Fireworks, as defined by A.R.S. §36-1601 including “consumer firework” and “permissible consumer firework,” are prohibited on University Property unless expressly authorized by University officials with actual authority to provide such authorization and related to a University Authorized Activity.
Propane grills or electric cooking/heating appliances are the only cooking devices allowed on campus, unless otherwise prohibited under this policy or as a Camping activity. Wood, charcoal, liquid petroleum fuel, and other fuels are not allowed. Any requests for other types of cooking devices must be approved by the CUC and Risk Management Services.

The Dean of Students may make insubstantial changes to the wording of this document when such changes are required for clarity and do not affect the substance of the document. If one or more provisions of this document are declared inoperative or are otherwise voided, the remaining provisions shall remain in full force. The Dean of Students shall have the sole and final authority to interpret these policies and regulations, and those interpretations shall be binding.
The CUC annually reviews guidelines for the use of the Mall and other Designated Public Forum areas and assists the Dean of Students Office with event approval as needed. The CUC is composed of the Dean of Students, who serves as chair; representatives from the Arizona Student Unions, University of Arizona BookStores, Facilities Management, Risk Management Services, Parking and Transportation Services, Arizona Athletics, UAPD, Campus Recreation, Housing and Residential Life, University Relations, and the University Activities Board; a faculty representative; Campus Use/Commercial Activity Coordinator; an ASUA member, a GPSC member, and a student organization president.
The Campus Use Policy will be enforced by the Dean of Students Office, the Arizona Student Unions, Risk Management Services, and UAPD.
